My New Jersey corruption charges center around a corrupt New Jersey law firm (MAYNARD & TRULAND) that used its tremendous state-wide/court-wide influence to suppress Legal Malpractice charges against them.     One of the corrupted lawyers of the firm (Robert Correale) had a second job working for the State of New Jersey.

   Robert Correale happened to be Vice-Chairman of New Jersey's Supreme Court Office of Attorney Ethics.

Back in 2003, my Legal Malpractice evidence beat Maynard & Truland and Robert Correale in NJ Superior Court, but when I asked for this court transcript to use in a higher level of Superior Court, the transcript could not be typed for release, because the reporter's notes went strangely missing.   Since I didn't have the transcript from the lower court, the Law Division judge threw my civil case out for a lack of merit.

     Because of the missing court transcript, later, the New Jersey Superior Court Appellate Division threw my case out for the same lack of merit and placed a gag order on me. The Superior Court judges supplied me with no reasonable accommodations for serving PRO SE, or the fact I was disabled with Post Traumatic Stress Disorder (PTSD).

My legal malpractice evidence is the law firm's own contact and invoices and many New Jersey Supreme Court and Superior Court documents and filed letters. I also have my Veterans Affairs (VA) medical records to show the impact this saga has had on my disability and my family.

      It's been a six year ongoing cover-up. But it is well-documented.   It's been a battle, but with the internet, I'm starting to get some verbal support and it's giving me some hope that I'll finally get my Due Process.



After one of their attorneys committed Gross Negligence, the firm’s partners Joe Truland and James Maynard (Without client permission) switched attorney responsibility of the law case to another Maynard & Truland attorney Robert Correale, who happened to be the Vice-Chairman of New Jersey’s Supreme Court Office of Attorney Ethics.
       Robert Correale went on to commit a number of ethics violations of his own: False Billing and Over-Charging are just two.

NJ Superior Court Transcript went missing before it could be typed by the Superior Court clerk.

Have you ever heard of anything so strange?   This court transcript was going to be used by Jack Cunningham in a Superior Court Law Division Legal Malpractice civil case against Vice-Chairman Robert Correale, a high level New Jersey State Attorney Ethics Official. It was also going to be used in a formal New Jersey Supreme Court Attorney Ethics investigation against Robert Correale and his Law Firm, Maynard and Truland.   Because this evidence was lost (destroyed), both New Jersey Courts were able to throw out both of Jack Cunningham's cases and now Robert Correale,Esq. is a district attorney of Vernon Township and Andover Township, New Jersey.

I sent the below letters to New Jersey Governor Jon Corzine and his Attorney General on 2/21/2006. The State Government’s official post office signed for the letters on 2/23/2006.
I have never received a written response to the below letter from anyone in New Jersey Governor's Office or his appointed Attorney General's Office.

On 3/6/2006, since I did not receive an acknowledgement from Governor Corzine’s or his Attorney Generals’ offices, I called the Governor’s office. I was informed that the governor’s office received my letter and it was passed onto the New Jersey’s Department of Law and Public Safety, which is under the Office of New Jersey’s Attorney General.

Three years ago, back on February 18, 2003, Governor James McGreevey’s office did the same thing.   But back then, the New Jersey Office of Law and Public Safety “passed the buck” right to the same New Jersey State government office that had the Conflict of Interest. Although I wrote in numerous letters that the New Jersey Office of Attorney Ethics was performing a cover-up, the Attorney General’s office disregarded my letters and sent my request for an investigation back to the Office of Attorney Ethics. It’s been a five (5) year battle for me trying to receive my DUE PROCESS.

The NEW JERSEY SUPREME COURT's Office of Attorney Ethics can not properly investigate my complaints due to a major Conflict of Interest.   They have already proven that they can not fairly judge one of their own Vice-Chairman. Currently, there are no active court cases going on in the State of New Jersey over my Ethics Complaints against New Jersey's Office of Attorney Ethics, their Vice-Chairman Robert Correale and his Law Firm.

Vice-Chairman Robert Correale and his law Firm, Maynard & Truland were able to use their tremendous influence and power to their advantage in both a New Jersey Supreme Court Office of Attorney Ethics investigation as well as a Civil case for Legal Malpractice.   My evidence is clear about their use of their tremendous influence around the State of New Jersey.

Former Governor James McGreevey personally thought enough about my evidence that he even supplied me with the phone number of the Director of New Jersey Supreme Court's Office of Attorney Ethics.  Governor McGreevey’s Attorney General office also sent communications to Director Johnson asking that I receive DUE PROCESS for my ethics complaints.       On September 6, 2000, I hired the law firm Maynard & Truland, LLC of Morristown, NJ to represent me in a divorce case initiated by my former wife. I was informed by the firm’s partner Joe Truland, Esq. that he had recently hired a divorce attorney.    (Custody of our two minor children were both their mother's and my concerns.)

I signed the Maynard & Truland Contract and paid the accepted $750 retainer http://www.americans-working-together.com/attorney_ethics/id9.html .   Six days later, my $750 Retainer Check cleared my checking account. Twenty-two (22) days later, due to the Gross Negligence of the Maynard & Truland divorce attorney Edward Buschio, I was placed in a divorce default for lack of activity on my Law Firm's part.   (My own Law Firm placed me in default, where I could actually lose custody of my two daughters. I was extremely worried... I'm sure most fathers or mothers would be extremely worried too!)

At the time of the default, the Sussex County Superior Court and my former-wife's attorney didn't even know I had retained a Law Firm.   My Law Firm, which had cashed my $750 retainer-check weeks earlier, failed to send out the required document to the concerned parties.    (HOWEVER IN A SWORN CERTIFICATION TO NEW JERSEY'S SUPREME COURT OFFICE OF ATTORNEY ETHICS, ROBERT CORREALE, ESQ. STATED THE PROPER DOCUMENTS WERE PREPARED. During those twenty-two (22) days leading up to the default, I phoned Maynard & Truland’s divorce attorney Edward Busichio a number of times reminding him of the approaching Default Deadline. Each call, I spoke to the Maynard & Truland office manager and I requested a return phone call. However, no calls were returned by Maynard & Truland. After I was placed in Divorce Default, in spite of my letters and phone calls to Partner Joe Truland and his divorce attorney Edward Busichio, the law firm did not start work on my case until sixty-nine (69) days after I signed their contract and paid them the $750 Retainer. The evidence of this fact is found on three different formatted Maynard & Truland Invoices. The default was due to the Maynard and Truland divorce attorney's negligence for not filing the necessary papers to New Jersey's Superior Court. Why the law firm was charging me, I was not sure. I questioned these charges (At the over-charged rate) even in my first letter to New Jersey's Supreme Court Office of Attorney Ethics.

Sometime after the Default and before the start-work-date (69 days into the contract ), the Maynard & Truland supervising partners, without my prior approval or my notification, switched my divorce case representation from their divorce attorney Edward Busichio to one of the law firm’s general practice attorney Robert Correale. What made this so secretive switch, so interesting is that Robert Correale was the Vice-Chairman of New Jersey’s Supreme Court Attorney Ethics. I never did receive notice why this switch took place, so eventually through evidence, I started thinking that the switch was to use Vice-Chairman Robert Correale’s influence around the State of New Jersey, if I brought up ethics complaints against the Maynard & Truland law firm.    I was up against the reputation of a distinguished attorney and state government official, and the reputation of the New Jersey’s Supreme Court Office of Attorney Ethics.

SOME OF THE ETHICS PROBLEMS:

New Jersey’s Supreme Court Attorney Ethics Vice-Chairman Robert Correale did the billing for Default Removal at an over-charged rate. Although the Divorce Default was due to divorce attorney Edward Busichio’s gross negligence, the Vice-Chairman of Attorney Ethics felt that I should be charged at a $175 an hour rate.   The Maynard & Truland Contract states that the first 10 hours of attorney work was to be charged at the $150 per hour rate.   All work after the first ten hours were to be charged at the $175 rate.
     Although I brought these two billing problems to Maynard & Truland partner Joe Truland and Robert Correale’s attention in writing, Robert Correale continued to over-charge me and never removed the charges for Default Removal.   The three different formatted invoices in conjunction with the Maynard & Truland Contract are all extremely clear.

In December 2000, I first started complaining about Maynard & Truland’s ethics problems to New Jersey’s Supreme Court Office of Attorney Ethics.    I wrote to their District X Ethics Committee that covers both Morris and Sussex Counties of New Jersey. My letter and the evidence I attached to it, clearly highlighted the amount of pain I was under due to ongoing ethics violations. However, I got no where, since Vice-Chairman Robert Correale was the Vice-Chairman of that same committee. A Conflict of Interest was never mentioned in their return letter to me.    They must have known that the Morris County New Jersey Law Firm, Maynard & Truland was the same law firm of their Vice-Chairman Robert Correale. Two of my evidence letters that were attached to my complaint letter to District X Attorney Ethics were addressed to Robert Correale, himself. One of my favorite ethics violations of Robert Correale was the day of Divorce Arbitration in Sussex County Superior Court on February 14, 2001.   Robert was a general-practice attorney and he gave me the impression that he had not served on too many divorce cases. The last time I received DUE PROCESS from the New Jersey Court Systems was March 11, 2003.   Maynard and Truland, LLC brought me to New Jersey Superior Court for a Civil Case for refusing to pay the remainder of their open bill of $1,600. The Law Firm served their papers for this Superior Court Civil case to me in December 2002, a few days before Christmas.     Within days, I counter-claimed on the same docket for Legal Malpractice.

OrignalIy, the Maynard & Truland firm had a collections law firm representing them in their open bill collections case. However, I sent the collections law firm some of my legal malpractice evidence I had against the Maynard & Truland firm.

March 11, 2003 was the court date in New Jersey Superior Court in Sussex County.   Vice-Chairman of Attorney Ethics Robert Correale, Esq. was there representing himself and his Law Firm MAYNARD & TRULAND, LLC.   The collections law firm was no longer part of the case.
       I had to represent myself PRO SE, because no attorney wanted to go against the local Vice-Chairman of Attorney Ethics without big money up front.
      I was a nervous wreck that day, but Honorable Superior Court Judge Ronald Graves had much of my evidence before him.   My evidence is what beat Vice-Chairman Robert Correale, Esq. and his law firm. He couldn't go against his own Law Firm's own contract, invoices, court documents; court filed letters and statements, my VA medical records, etc. (He had supplied the court no evidence to prove me wrong.)
     After Robert Correale’s objections, Judge Graves decided that my Malpractice Counter-claim warranted the New Jersey Superior Court Law Division for damages.

That same day, in a Sussex County hallway, Robert Correale informed me that I should NOT bring my Ethics Claim through District X due to a CONFLICT OF INTEREST. I informed him that I did not have a choice. The decision was NOT mine.
I asked Correale to please inform Trenton’s Office of Attorney Ethics about his Committee’s Conflict of Interest.

      Sometime after Honorable Judge Ronald Graves made his decision that my Legal Malpractice complaints warranted the Law Division for damages; strangely the court transcript went missing within Sussex County’s Superior Court before it could be typed. Since there were no record of Superior Court Judge Graves’ Law-Division-Merit-Decision, the Maynard & Truland attorneys were able to perjure themselves verbally in open court; as well as perjure themselves in official court documents. Serving as PRO SE, my Legal Malpractice civil case against Maynard & Truland went all the way up to New Jersey’s Appellate Division in Trenton, but was thrown out for lack of merit since Honorable Judge Graves’ decision in my favor couldn’t be used. The transcript was still lost within Sussex County Superior Court and was never found by the court stenographer.
Also, since I could not use Honorable Superior Court Judge Ronald Graves civil court decision as an outside opinion on my Office of Attorney Ethics complaints against Correale and his Law Firm, I did not have much chance of DUE PROCESS. The New Jersey’s Supreme Court Director Johnson’s Office assigned the complaint case to Robert Correale’s own committee that he was Vice-Chairman of.   The Conflict of Interest was not admitted by the Office of Attorney Ethics until hundreds of my letters went out.    Both Governor McGreevey and the New Jersey Attorney General office sent written correspondence and some of my evidence to Director Johnson. Governor McGreevey even supplied me with Director Johnson’s direct phone line and I called him a couple of times, but Johnson never returned my phone calls.

      After hundreds of my letters, the Office of Attorney Ethics finally switched the investigation from Correale’s District X to his neighbor in District XI.
District XI went through some minor motions.

In early May 2003, MAYNARD & TRULAND attorneys Edward Busichio, Robert Correale (Vice-Chairman of DISTRCT X) made sworn CERTIFICATIONS to District XI, Secretary Robert Stober. James Maynard supplied a cover letter with his own type of certifications. For unknown reasons, Joe Truland, Esq. (defendant and junior partner) did NOT supply a CERTIFICATION to District XI. Although these Supreme Court CERTIFICATIONS were sworn to, they were vague, misleading and at times, perjurious. None of the Maynard & Truland attorneys attached any evidence to their sworn Certifications.    Their written words were stronger than their Law Firm's own Contract and Invoices, Court filed documents, letters, statements and Federal Veterans Affairs (VA) Medical Records.

       On the other hand, I had sent to the District XI Ethics Committee, Maynard & Truland’s own contract, their own invoices, my Federal Department of Veterans Affairs (VA) medical records, court filed documents, court filed statements, court filed letters, etc.   It was pretty much the same evidence that I sent the Honorable Sussex County Superior Court Judge Ronald Graves, which he determined my Legal Malpractice evidence warranted the Law Division for damages.

Since one of my ethics complaints is related to MAYNARD & TRULAND, LLC over-charging for the first ten hours of the CONTRACT, both District X Vice-Chairman Robert Correale and Senior Partner James Maynard addressed MAYNARD & TRULAND, LLC billing procedures. Although both their interpretations were perjurious statements, their CERTIFICATIONS were accepted and NOT questioned by Secretary Robert Stober in spite of my sending a great deal of follow-up evidence. However, they did supply me with needed communications. Prior to these CERTIFICATIONS, MAYNARD & TRULAND, LLC never addressed my letters of October, November and December 2000.       A professional divorce attorney admitting the reason why I fell into Divorce Default was a surprise to him. His law firm did not start work until sixty-nine (69) days into the Contract. Edward Busichio, Esq. has been lucky that the general-practice attorney, who replaced him on my representation in my divorce case, was a Vice-Chairman of New Jersey’s Supreme Court of Attorney Ethics.

WHEN VICE-CHAIRMAN ROBERT CORREALE WAS TRYING HIS FELLOW    NEW JERSEY ATTORNEYS FOR ETHICS VIOLATIONS... WAS HE SO LAX WITH FOLLOWING SUPREME COURT GUIDELINES FOR TELLING THE TRUTH?

Isn’t five years too much to ask a PTSD Disabled Vet to battle for his DUE PROCESS?

Even in New Jersey, Deception should only go so far…

The veteran's evidence is the Law Firm's own contract, their invoices and their sworn New Jersey Supreme Court certifications. The veteran's evidence also includes court filed documents, court filed letters and court filed statements.

In spite of all this clear evidence, the battle is still going on for the vet. Once you learn the influence of this law firm has in high levels of New Jersey Government, you will understand.

- The veteran's ethic complaints started with the Law Firm divorce attorney's neligence, over-charging per hour, false billing, etc... The Vice-Chairman of Attorney Ethics was the attorney on record for his Law Firm. Besides serving as New Jersey Vice-Chairman of Attorney Ethics, he was a general-practice attorney for MAYNARD & TRULAND.

THE EVIDENCE IS HIGHLIGHTED BELOW.

How could a Superior Court clerk lose a court transcript before it could be typed and released?   By the way the Law Firm lied in court after the loss of the transcript is a crime. We have all the evidence to prove these facts...

On December 21, 2000, I first wrote a letter to the New Jersey Supreme Court's Office of Attorney Ethics complaining about the Maynard & Truland law firm in Morristown, New Jersey and their attorney Robert Correale.   Maynard & Truland was a law firm that I retained to represent me in a Superior court case. We were four months into the contract, so I did not want to change the law firm; I just wanted Maynard & Truland and their attorney Robert Correale to act professionally. My complaints in the letter were Maynard & Truland's complete lack of professionalism, which included their gross negligence, their (Correale) overcharging me, their (Correale) false billing, their (Correale) inability to have me removed from a court default that they caused themselves and their (Correale) complete lack of communications. I no longer wanted to feel like I was fighting Maynard & Truland and their attorney Robert Correale, more than the real opposing parties.

I opened my letter to NJ Supreme Court's Office of Attorney Ethics explaining that I was a veteran from the Vietnam War and that I was disabled with PTSD, due to heavy combat from living and serving (24/7) in a Vietnamese peasant village. I added that I suffered from chronic pain resulting from a terrorist bomb blast that I received in the village. I highlighted how Maynard & Truland's lack of professionalism was greatly exacerbating my PTSD and chronic pain.   At the time, I was not looking for anything other than Maynard & Truland to represent me in a professional manner, yet understand I suffered from veterans disabilities. With the letter, I included a federal Veterans Affairs (VA) diagnose statement as well as VA medical progress reports, which clearly stated the impact Maynard & Truland ethics violations were having on my disabilities. I also supplied letters that I sent Maynard & Truland's attorneys begging them to act professionally. I supplied all this personal information in the hope the State of New Jersey would provide me with some reasonable disability accommodations and insure that the law firm acted professionally.

Six days later, the Secretary of District X Ethics Committee, Bonnie C. Frost wrote a return letter that stated, due to New Jersey Court rules, their office could not do anything to help me. She added I was free to get advice from another attorney.

Whether it was warranted or not, the Office of Attorney Ethics - District X's lack of support just added to the anxiety and even opened the door for Maynard & Truland to continue ongoing ethics violations. Their over-charging, false billing, negligence, lack of communications continued. At one point a Maynard & Truland attorney arrived unprepared at Superior Court for an arbitration, and I was forced to represent myself as their attorney sat quietly to my left.   I ended up getting charged over $600 for the attorney just sitting there. (Even this, he charged at the inflated rate.)

A little over two years later, when I refused to pay their open bill, Maynard & Truland attorneys brought me to Superior court for $1,700. I counter sued on the same docket for Legal Malpractice against the firm. During a break in the court proceedings, I learned that the Maynard & Truland attorney Robert Correale was the local Vice Chairman of New Jersey's Supreme Court Office of Attorney Ethics. He was himself responsible for bringing official ethics violations to New Jersey's Supreme Court for himself and his law firm, Maynard & Truland. This was the same Attorney Ethics Committee that I asked to support me two years before. (Major Conflict of Interest)

The detailed evidence, I supplied the Superior Court Judge Ronald Graves on the Open Bill/Legal Malpractice case that day was enough for the judge to decide against Vice-Chairman of Attorney Ethics Robert Correale and his law firm. Their open bill charges were dropped and the judge determined that my charges of legal malpractice warranted (merited) the Superior Court Law Division for damages.

When I brought the Legal Malpractice case to Superior Court Law Division, Judge Ronald Graves court transcript was missing and could not be typed. It actually disappeared. My Superior Court Law Division Legal Malpractice case against the Maynard & Truland law firm and Vice-Chairman of the New Jersey Supreme Court Office of Attorney Ethics Robert Correale was then thrown out of Superior Court for lack of merit. How convenient was this...

Vice-Chairman of Attorney Ethics Robert Correale and his fellow Maynard & Truland attorneys were later cleared by the Office of Attorney Ethics, when they swore to written Certifications to the New Jersey Supreme Court, which were filled with perjurious, misleading and vague statements.

This Superior Court transcript went missing in 2003. The State of New Jersey is still looking for it. Although, I have written numerous letters to the federal Department of Justice requesting they assist me in getting my Civil Rights and Due Process from the State of New Jersey, the Department of Justice insists this is a New Jersey issue and they refuse to help.   My years of certified letters to New Jersey governors, attorney generals, NJ federal senators, NJ court systems go unanswered.

In 2010, the Cover-Up still goes on...   Former Vice-Chairman Robert Correale, his former attorneys at Maynard & Truland and those politicians and state government officials, who protected them for almost ten years, stay above state and federals laws.

Currently, my State Senator Steven Oroho has been investigating this and has been since November 2008. I'm also trying to get my federal Congressman Scott Garrett involved in getting me my Due Rights and charging the State of New Jersey with denying me my civil rights for almost ten years and the violating the Americans with Disabilities Act for not giving me reasonable disability accommodations in the New Jersey Supreme and Supreme Court systems.

This still remains the biggest topic of my Veterans Affairs (VA) therapy sessions and the exacerbation of my PTSD and chronic pain continues.   But the one thing I know, I won't give up trying to get justice from the federal and state government.

I never want to see this happen again to another PTSD vet or regular citizen.

On March 11, 2008, my wife and I went to the F.B.I. office in Newark, New Jersey.

To be honest, I felt I was stonewalled by the two agents, who I spoke with from Public Corruption Squad 8.   The lead agent refused to review my evidence, unless I had original documents with me.   He told me I could have typed the documents myself.   Three of the documents were New Jersey Supreme Court Attorney Ethics Certifications, along with Maynard & Truland's Contract and Invoices). When I asked the federal agent, if it was a crime for me to make up false evidence and lie to F.B.I. agents, he didn’t answer me.



The discussion went down hill from there. However, I did get the two agents to review part of my evidence, including the part that they thought I may have typed myself   (The New Jersey Supreme Court Attorney Ethics Certifications, along with Maynard & Truland's Contract and Invoices).

      When I asked the lead F.B.I. agent, if my Civil Rights to Due Process were being violated, he said no.   I also asked, if the State of New Jersey should have given me "Reasonable Disability Accommodations" for my PTSD.   He just repeated that no federal laws were broken.

      Since the agents refused to review the New Jersey Supreme Court Attorney Ethics Certifications, along with Maynard & Truland's Contract and Invoices, because they were not the originals, I actually had to play make-believe.

      They looked through part of the Certifications of James Maynard & Robert Correale and compared it to the Maynard & Truland's Contract.   The F.B.I. agent admitted that all three contradicted each other when it came to the law firm's billing and Retainer paragraphs.   Without farther information, the agent said the Maynard & Truland contract was wrong.

      After the agent examined Robert Correale's certification pertaining to the day he first started work on my case and compared it to his law firm's invoice's start-work date, the agent brought up again that I may have typed the documents myself.

      What knocked me almost out of my chair was when the agent told me that Superior Court transcripts can get lost before they can be typed.       In the end, I was told that my corruption charges against the State of New Jersey were for civil court in the State of New Jersey. Since no federal crimes were being broken by New Jersey State officials and politicians, I had to deal with the State of New Jersey. When I informed the agents that the New Jersey Governor’s office and his Attorney General’s office do not even answer my certified letters, I was again informed that they are not breaking any federal laws.

For over seven years now, New Jersey's governor’s office, attorney general’s office, NJ Supreme Court & Superior Court and Office of Attorney Ethics are still protecting former New Jersey Supreme Court Attorney Ethic’s Vice-Chairman Robert Correale and his former Law Firm, Maynard & Truland.

Due to the Conflict of Interest of Robert Correale being a Vice-Chairman, I have been asking for an investigation outside the Office of Attorney Ethics.

The Governor's office, his Attorney General's office, Senator Robert Menendez's office and NJ Supreme Court Office of Attorney Ethics all insist that Robert Correale's former District X committee investigate my charges against him and his former law firm, Maynard & Truland. Back in 2003, after a deluge of my letters, the Office of Attorney Ethics had their nearby committee, District XI do a perjury-filled, malfeasance, lame investigation; where they found Robert Correale and his former law firm, Maynard & Truland cleared of all charges. Correale and his law firm’s lawyers supplied no supporting evidence with their sworn certifications. I supplied Maynard & Truland’s own Contract, Invoices, along with Superior Count Documents and court-filed letters.

Robert Correale’s and his fellow attorneys’ perjury was accepted without question by District XI Attorney Ethics Official Robert L. Stober 973-778-0154.

Honorable New Jersey Governor Jon Corzine at 609-292-6000. Over the years, Gov. Jon Corzine has received at least seven U.S. mail letters (three certified) and over twenty emails on this subject with attached evidence, but his office has not returned any communications.    Ask his aid Susan, why she does not return my phone calls and why her staff refuses to give me her last name.   There are two Susan's, who work in Corzine's Office.

I lose it, when it comes to my New Jersey corruption crap. I've been in this battle with the State of New Jersey for over six years now.

      My New Jersey corruption charges center around a corrupt New Jersey law firm (MAYNARD & TRULAND) that used its tremendous state-wide/court-wide influence to suppress Legal Malpractice charges against them.     One of the corrupted lawyers of the firm (Robert Correale) had a second job working for the State of New Jersey.

      Robert Correale happened to be Vice-Chairman of New Jersey's Supreme Court Office of Attorney Ethics.

It's been a Vietnam PTSD veteran against a New Jersey Supreme Court Office of Attorney Ethics Vice-Chairman the entire uphill battle.    I've been tag-teamed by Maynard & Truland's corrupted lawyers and their corrupted friends in the New Jersey State Courts, New Jersey Governor's Office and his Attorney General Office.

     I've been handling my charges PRO SE, because there is NOT a lawyer in New Jersey who would go against New Jersey's Supreme Court Office of Attorney Ethics...   especially a Vice-Chairman.    (That's like career-suicide.)

      Back in 2003, my Legal Malpractice evidence beat Maynard & Truland and Robert Correale in NJ Superior Court, but when I asked for this court transcript to use in a higher level of Superior Court, the transcript could not be typed for release, because the reporter's notes went strangely missing.   Since I didn't have the transcript from the lower court, the Law Division judge threw my civil case out for a lack of merit.

     Because of the missing court transcript, later, the New Jersey Superior Court Appellate Division threw my case out for the same lack of merit and placed a gag order on me. The Superior Court judges supplied me with no reasonable accommodations for serving PRO SE, or the fact I was disabled with Post Traumatic Stress Disorder (PTSD).

My legal malpractice evidence is the law firm's own contact and invoices and many New Jersey Supreme Court and Superior Court documents and filed letters. I also have my Veterans Affairs (VA) medical records to show the impact this saga has had on my disability and my family.

      It's been a six year ongoing cover-up. But it is well-documented.   It's been a battle, but with the internet, I'm starting to get some verbal support and it's giving me some hope that I'll finally get my Due Process.

     Webmaster Jack Cunningham (Sussex, NJ) and George Dros (Cooperstown, NY) are sitting at a table in a Duc Duc Refugee Village peasant hut, near the village's market place.   The two, young United States Marines are members of CAP Team 2-9-2. (CAP Teams were composed of about 8 to 13 Americans, who lived and served 24/7 in Vietnamese peasant-farming villages.    The Duc Duc Refugee Village was composed of about 2,000 homes.)

In the above picture, Jack's and George's eyes were shut, because of complete exhaustion. It was July 1970. At the time this picture was taken, the Americans in Duc Duc were not sure whether the CAP Unit would be pulled out of the village or whether it would be wiped out. We were experiencing heavy combat. Intelligence reports were coming in daily that the Communists wanted to punish the village while the Americans were still there.

      By wiping out CAP 2-9-2, the terrorists hoped to leave an example to other CAP Villages. With alerts at the highest level, night ambush responsibilities were 100% watch throughout the night. With two long patrols a day going outside the village, it didn't leave much time for the eight or so Americans to sleep.

     Around the day this picture was taken, an intelligence report came in from the 1st Marine Division Headquarters in Da Nang that the high Communist Command wanted to speed up President Nixon's troop pullout from Vietnam. They wanted to embarrass the Americans on a wide-scale and influence the American People into pressuring a faster troop pullout. Their plan called for wiping out the Fifth Marines at An Hoa. It was going to involve thousands of Communist Forces. The Village of Duc Duc was on the large Marine Base's perimeter and was said to be the main route for the Communist attack. Our orders that night in July 1970 was to set up in the most well protected position. Our Cap Unit was expected to try and hold off the Communist drive off as long as possible. We were expected to serve as a warning or trip wire (Queens Gambit) for the Fifth Marines.

Months after Jack and George pulled out of the village of Duc Duc, the Vietnamese communists punished the peasant village by burning it to the ground. Hundreds of civilian men, women and children were killed, wounded and reported missing. Two thousands homes were reduced to ashes.   The blaze could be seen from twenty-five (25) miles away in Da Nang.   It was the light of the blaze that guided United States Marines helicopters to the scene.

The boy with Jack is the Marine's village boy. These village boys would run errands, cook C-Rations, clean up-after, massage tense muscles and serve as interpreters for the Marines. Usually, each Marine had their own boy to help him around the village.

Many times, adult peasants of Duc Duc would supply these boys with intelligence information of planned terrorist attacks on the village.   Supplying these intelligence reports on terrorist movements and plans may have been the reason why the Duc Duc Refugee Village was later burned to ashes.

A month after the above picture was taken, the boy lost both of his parents in a terrorist rocket attack on their area of the Duc Duc Refugee Village.   After his parents were killed, the boy moved to a relative's home closer to the City of Da Nang; which in the long run saved his life the night of the Duc Duc Massacre.

JULY 17, 1970

      On what was going to turn out to be my hottest day in Vietnam, we had asked our (new to the village) sergeant for just a short, daily patrol.   Although it was still morning, we had already completed a number of our daily assignments around the village and the temperature was already scorching.   As usual, our Navy Corpsman already had treated a long line of peasants and my buddy, George Dros and I (our unit’s demolitionmen) had already setoff a couple of controlled explosions of dud high explosive rounds that the local children collected. The loyal children received payments based on the size of their dud round.

    The CAP 2-9-2 patrol of five Marines and six Vietnamese Popular Forces (PFs) Militiamen left Phu Da with full gear.   Sergeant Donald Eifford led the patrol down a small, dusty path between two tall cornfields.   I was the M-79 Grenadier and a Lance Corporal.   When we exited the cornfields, Sergeant Eifford took out his field glasses and spotted three figures entering a known Viet Cong frequented treeline.     The treeline was once the site of a peasant village.

      Since no villagers were allowed that far from Phu Da, it was safe to believe that the three figures entering the treeline were Communists.   Sergeant Eifford radioed for mortars on the jungle treeline from the Fifth Marines Headquarters at An Hoa.   (Only a month before, CAP 2-9-2, two tanks and a company of about 130 Marine Grunts from the Fifth Marines worked the same area. Even with all those Marines and supporting equipment, the treeline was a bad neighborhood to say the least.)

        Using Eifford’s map grid coordinates, the Marine mortars from An Hoa were very accurate.   (He was excellent at calling in support for us.)   Our sergeant decided for the eleven-man patrol to go after the Communists.

        About a mile into the thin, open rice patty dikes, fear triggered five of our six Village Militiamen to refuse to go any farther toward the mile long piece of jungle.   Even though we tried to influence their decision, the militiamen refused. They were terrified.   To be honest, having experienced combat there myself, I was a little worried.   Without the other PFs, there would be only six of us in the thick treeline.

      Like I already mentioned, the last time we dealt with the Communists in the same piece of jungle, we had about 130 men and 2 tanks.   In spite of all the men and equipment, we still had to call in F-4 Phantom fighter jets for a couple of bombing runs.

     The lone Vietnamese militiaman, who agreed to go along with us, was walking point (first) anyway. He had to pass through five Marines on the less than two-foot wide rice patty dike in order to leave with his buddies.

     As the CAP 2-9-2 patrol came close to the treeline that only minutes earlier three Communists entered, the sergeant ordered me to walk point (first) and slam the face of the treeline with M-79 Grenade Rounds.   Immediately, I moved up in line and started firing.   About a hundred yards outside the large treeline, we had to stop. My grenade launcher jammed from a BeeHive (shotgun-like) round casing.    I cleared my weapon and reloaded with just high explosive rounds.

       (In the Command Chronology for CAP 2-9-2 for July 17, 1970, it was documented that I shot a total of 22 M-79 High Explosive (HE) rounds that entire day.   Although I picked my targets well, I thought that I shot much more than 22 high explosive rounds.   It was a long day under the hot sun.)

      Once we entered the jungle, we immediately spread out into two-man teams and found Communist huts, bunkers, and trenches and stored food supplies.   My buddy

L/Cpl. George Dros did some extra searching under some heavy jungle canopy.   Inside a large hut that George found was Communist military documents and the equipment for making booby traps.   In another hut, we found freshly cooked rice still warm in four bowls.

    We were elated that we chased off the Communists.   I took my handy Kodak Instamatic Camera from my field jacket and started taking pictures. A couple of the guys even posed.

      This feeling of satisfaction lasted only a few minutes.   Suddenly, we were hit from what seemed like every direction.    The Communist fire was extremely intense.

      Immediately, Sergeant Eifford radioed for mortars from the An Hoa Fifth Marine Base.   The Willie Peter placing round was right on target.   However, probably because of the shifting of the M-81 mortar’s tri-pod, the ten M-81 high explosive rounds walked directly towards where we were pinned down.   We thought that our own mortars would kill us.   I didn’t know what to do. The thought of moving to my right or left was out of the question. The Communist fire was too furious. The last round exploded only about 20 yards in front of us.

      After calling in the mortars, our sergeant called in helicopter and fixed-wing air strikes.    During one of the initial passes over the trees, the fixed-wing pilot spotted a cluster of huts deep in the treeline. He concentrated his ordinance and succeeded in triggering some secondary explosions.

      During all the action, the rest of the Marines from CAP 2-9-2 and a few Vietnamese PF militiamen arrived from Phu Da.   Meanwhile, CAP 2-9-1 from the other side of the

An Hoa Marine Base rushed to our aid, but they got pinned down just outside the treeline that the six of us were surrounded in.

     For a number of hours, we had to fight off the Communists ourselves.    It was in July and the temperature was said to be over 100 degrees.    (I don’t remember for sure, but the number 110 comes up.   Our Navy Corpsman had his mother send a thermometer just about a week before.   (He was always saying how hot it was.   It became a joke for us.)    Regardless, whether it was 100 or 110 degrees, it was extremely hot.   Water ran

out early.

     Once CAP 2-9-1 arrived, the Communists broke contact with us.   As the CAP’s demolitionmen, George Dros and I blew as much as we could with our C4 plastic explosives.   After we ran out of C4, George and I collected some hand grenades and destroyed the remaining Communist belongings and equipment.

     It was very important what route we left the jungle.   We needed to take a route that the enemy would not expect us to take.   Otherwise, the Communists would be setting up an ambush for us.   We set up security then left the treeline together on a route that crossed through a chest high, slow moving stream.   (My camera’s film was destroyed.) While in the stream, a few guys were a little nervous about the poisonous snakes, especially the deadly Bamboo Viper.

       Once on the other side of the stream, CAP 2-9-1 left for their own village. The Americans and the few PF Militiamen of CAP 2-9-2 rested on a small knoll for a couple of minutes.    We were out there under some ugly conditions for many hours and we needed a much-needed rest.   Besides, our water ran out hours before and a few of us were near Heat Exhaustion.   Myself included.

       Our Navy Corpsman was tired of telling us not to drink the filthy rice patty water.   Since the patties were the universal toilets for their peasant caretakers as well as water buffaloes and the watery grave of many insects, the Corpsman didn’t appreciate us drinking the filth through our closed teeth and then wiping our teeth clean.   (We didn’t bring our toothbrushes.)   Our sweat-soaked, camouflaged utilities were our tooth implement of necessity.

       Three of my buddies went to search for some desperately needed clean water.

           (The problem was the three Marines went without their weapons. I’d

           say the intense heat; the day’s activities and lack of water were getting

           to them.)

         After only a few minutes of rest, our sergeant jumped up.   He was in a hurry to get back to Phu Da for fear that the Communists might attack the unprotected village.   (One of the Vietnamese Militiamen might have read one of the Communist documents that George Dros found in the makeshift booby trap factory.)

        I told the sergeant that the three men went for water without their weapons.   I volunteered to stay.    All I cared about was that my friends were out there with no weapons.

      The Communists must have followed us.   About fifteen minutes later, as my three, joyful, wet-buddies were returning with the much needed water, the Communists attacked with rifle fire and small explosive weapons.   For protection, each of my buddies drove into a large, rice patty filled with water. It was about a hundred yards wide and it separated us.

      For the next fifteen to twenty minutes, I fought alone in the open to draw the Communists' fire, so that my buddies would survive or not be captured. The sounds of the zinging bullets and bombs were constant.

                         Thank God, those Viet Cong Terrorists were bad shots.

       In order to give the impression that there were more Marines on the knoll than just me, I switched between my M-79 Grenade Launcher to my buddies' M-16 Rifles and a

M-60 Machinegun. However, I'm sure it didn't take long before the Viet Cong Terrorists realized I was the only American on the small knoll in the middle of the open rice patties.   If they killed me, the V.C. Terrorists could just walk up to my buddies and do what they wanted to them.

                                 (The Communist fire was pretty fierce.)

       I was no different than any other American in the Combined Action Program.   The thought of leaving my Cap Brothers did not even enter my mind.   At the time, we only had about eight Americans living in Phu Da.    I loved them.    One of my buddies pinned down before me in the rice patty was even married and had children. Some of George Dros' comments are below.

      You could say that back then; I felt my buddies were all I had.    Due to a number of different circumstances, we felt very alone.   Even, many American people back home were against us fighting the Communists. In June 1970, during a military sweep just outside our village, we found thousands of American Dollars that were donated to the Communist Terrorists by an American College student group at Berkeley University.   The donated money may have been used for the bounties on our heads.

       I served in Phu Da during the student shootings at Kent State University.

       I was also in Phu Da when my hometown of Rosedale, Queens had its Vietnam Veteran Memorial attacked twice by tar and paint during 1970.     (It's the first Vietnam Veteran Memorial in all of America.)

         Back at the knoll, a couple of the Marines who left with my sergeant returned to help but it took them some time walking along the thin rice patty dikes.   For all they knew, they were walking into an ambush themselves.    Our sergeant led the rest of the CAP 2-9-2 Americans and Vietnamese PFs back to protect Phu Da from a possible Communist attack.

       Daniel Gallerger was the first Marine to arrive to help me.   He came into the firefight shooting his weapon and laid down right next to me.   Daniel’s on The Wall in

Washington DC for something that happened months later.   He was a good Marine.

      In the end, everyone was saved and my sergeant received a well-deserved medal for his actions.   It was a miracle that no Americans were hurt that entire day.

      On July 22, 1970, CAP 2-9-2 returned to the jungle treeline with three infantry companies (C, E, and F) of the Fifth Marines, tanks and CAP 2-9-1.

     My buddy George Dros (one of the guys I saved) wrote his parents about the episode and they wrote and thanked my parents.   I felt great.

       To this day, George and I are extremely close and we both live up here in the beautiful, hilly farmland of Sussex County, New Jersey.    However, we don't really talk much about the war portion of serving in Phu Da, Vietnam.   To this day, it's still extremely hard to talk about the ugliness of war.     Instead, we talk a lot about our American Buddies as well as our Vietnamese Friends and the many Vietnamese Parents and Vietnamese Grandparents who adopted us into their families.

ACTUAL UNIT REPORT FOR JULY 17, 1970

17 July 70

A PF member of a CAP 2-9-2 patrol accidentally detonated an unknown type booby trap rigged with an unknown type firing device alerting an enemy ambush at AT 872500, 2.5 km N of Duc Duc District Headquarters. The patrol received SAF and returned fire with organic weapons fire, 22 M-79 HE rds,

2 M-72 LAAW rds, and called a helicopter gunship fire mission on the enemy. The enemy fled in an unknown direction. One PF was WIA by the exploding SFD. The PF was rendered first aid and medevaced by helicopter. A sweep of the area was nonproductive. RESULTS: 1 PF WIA(E).

Some time in July 1970, we went on a (daily) patrol that took us farther into enemy territory than ever before. The temperature this day was in excess of 100 º. With only three (3) other Marines and 1 Chou Hoi, we confiscated a large cache of Vietnamese communist terrorists (V.C) explosives, detonators, documents and battle plans for upcoming engagements.    (This most probably was a small terrorist bobby-trap factory.)

After neutralizing their base camp, we were hit by Viet Cong terrorists’ rocket-propelled grenades, mortars and small arms fire, pinning us down for over an hour.   We called for artillery from the Marine Cops’ 5^th Marines Combat base at An Hoa and a react team from our brother CAP team 2-9-1.   Return artillery fire was immediate.

      It took CAP 2-9-1 a while to reach us, because as they neared the tree line that we were pinned down in, they were also fired upon.

After about three hours, the V.C. broke contact and both CAP teams started back to their respective villages. We had to cross a chest deep river, carrying our weapons over our heads, but at least we were in our own back yard. We stopped on a small knoll for much needed water, since we had run out of water hours before, because of the intense heat and sun. Two Marines and I filled everyone’s canteens while Jack and the rest of the patrol stood cover.

Returning from the well, I saw Jack standing cover by himself, as Sgt. Eiford thought the village might be hit and took the rest of the unit back with him in case of enemy contact. As we made our way to the knoll that Jack was on, we took heavy fire from our right, pinning us down behind a small rice paddy dike. Jack then exposed himself to enemy fire to try and keep the V.C. away from us, switching from his own M79 grenade launcher, to my M-16 rifle and one of the Marines’ M-60 machine gun. Jack kept the V.C. off balance long enough for us to pull ourselves along by the rice stalks until reaching him. The V.C. broke contact, probably fearing an artillery attack.

This was Jack, always caring and making sure the people he loved were safe and protected from harm. Jack’s code in life has always been the same: passion for his family, his country and the Corps. I will always be thankful for being a part of Jack’s family.

Jon Corzine has received the same evidence as Senator Frank Lautenberg and Senator Robert Menendez. Yet, these two federal senators are already supporting me in my request for an investigation.
