Sussex County Tea Party Committee Announces Campaign
to Recall Senator Robert Menendez
A “Committee to Recall U.S. Senator Robert Menendez,” sponsored by the Sussex County Tea Party
has announced plans to launch an effort to recall Senator Robert Menendez from his position in office. Helping to lead the
charge is New Jersey Tea Parties United, the state's grass-roots coalition
of county and regional Tea Party groups representing several thousand members in support of fiscal responsibility, individual
liberty and limited government. The Committee filed a formal Notice of Intention to Recall with the Secretary of State's office
on September 25, 2009. While the office of the Secretary of State acknowledged receipt of the Committee's Notice
of Intention to Recall in a letter dated October 5, 2009, it has since provided no further communication. NJ state law
requires that administrators respond either with an approval or with a notice of non-compliance stating the reasons within
three business days of receiving the Notice, which was October 4, 2009. Since no response had been received, on November 25,
2009, the Committee filed a civil complaint in the Essex County Superior Court of New Jersey against Nina Mitchell Wells,
Secretary of State and Robert F. Giles, Director of the Division of Elections, demanding that the defendants be ordered to
immediately and forthwith comply with state law by issuing a response to the Committee’s Notice of Intention.
To date, the Secretary of State has ignored the Notice and the Complaint in violation of state law and the Committee is awaiting

Once the notice is approved by the state or by court Order, the Committee to Recall along with NJ Tea Parties
United will spearhead a large coordinated petition drive to collect signatures in support of a special recall election. NJ
state law requires a minimum number of signatures equivalent to at least 25% of the prior general election's registered voters
in order to grant a special recall election.
Appointed to a special one-year term by Governor Jon Corzine in November 2005, Robert Menendez was subsequently
elected in 2006 during the mid-term election and has served in the US Senate for just over four years as a Democrat representing
New Jersey. His term isn't scheduled to end until January 2013. The Recall Committee and New Jersey Tea Parties United
believe that Senator Menendez has sided with rigidly partisan politicians in his repeated votes for cloture on a variety of
key bills, stifling public debate in the Senate and denying New Jersey citizens transparency. For example, the Senator
voted down an amendment that would have prevented Medicare from being raided for new entitlements, and another that would have limited the government's control
over the health care of American families.
During this difficult financial period when Americans are cutting their own budgets and trying to save every penny, Senator
Menendez voted down proposals to remove from spending bills a number of extravagant, excessive multi-million dollar projects
that offered little or no short-term economic benefits. When an amendment was proposed to transfer some of the country’s funding for the United Nations
contributions to help offset the costs of providing assistance to family caregivers of our disabled veterans, he voted against
it. And in one case, Senator
Menendez voted against allowing each member of Congress and the Secretary of Defense to simply review the allocation of certain
taxpayer funds.
One NJ Tea Party member put it this way, “When NJ voters came out to the polls in November of 2008, they
voted for the transparency and accountability that was promised. Rather than believe his own constituents who have desperately
been trying to convey their wishes to him on health care reform without a government run option, he chooses to dismiss us,
making public statements on the senate floor that our concerns are all nothing more than the greedy insurance companies lobbying
to protect themselves.” It is statements like this that have convinced the Committee, NJ Tea Parties United,
and other tea party members that Senator Menendez is one of many elitists in government that are more concerned with promoting
their own careers than doing what is right for the American people. Those spearheading this effort hope that this will be
the first recall of many throughout the nation and that the Constitutional government of the United States can be restored
to the American people, to whom it belongs.

The Sussex County Tea Party movement
has gone to court in an effort to recall U.S. Sen. Robert Menendez based on a clause in the state constitution.
Before
the group can collect the requisite signatures to even attempt to have a recall election, it must win a court battle trying
to show that the state’s constitution supersedes the U.S. Constitution, which states only Congress can vote to
remove one of its members.
A message to Menendez’ press secretary Afshin Mohamadi was not returned.
RoseAnn
Salanitri, of Branchville, who describes herself as founder of the Sussex County Tea Party and was an original member of the
recall committee, said the recall is being done because of “a total disregard for the people’s wishes,”
on the part of Menendez, who was elected to his U.S. Senate post in 2006 with 53 percent of the popular vote. The effort is
being aided by the New Jersey Tea Parties United.
The effort already has run into a roadblock. In late September, the
recall committee sent a notice of intent to the state Secretary of State’s office, which would be the election official
in a statewide recall.
That office acknowledged receipt of the intent in early October, but, according to Salanitri,
has not followed up with any kind of approval, or disapproval, of the proposed petition.
Salanitri said state recall
law requires the election official to certify the petition as to language and form. When no response was made, the committee,
with help from the statewide group, filed a lawsuit in state Superior Court in Essex County in late November.
Dan Silberstein,
an attorney and a leader of NJ Tea Parties United, said last week he filed the lawsuit but did not have time to further discuss
it. He did not return subsequent telephone calls.
“It’s been frustrating,” Salanitri said. “We
do all these rallies, write all these letters and we get the most insulting form letters back.”
But, she added,
“People have felt empowered by this recall effort and energized by this.” Salanitri said she has since resigned
as a member of the recall committee for health reasons.
The committee is Suzanne Kimball, of Newton, Adrianne Knoblock,
of Sparta, and Darryl Haggerty, of Branchville.
Contacted Sunday, Haggerty said Menendez “does not represent
the people the way his oath requires that he does.” He then said he was not prepared to answer further questions.
The
news release said the recall committee and Tea Parties United believe Menendez “has sided with rigidly partisan politicians
in his repeated votes for cloture on a variety of key bills, stifling public debate in the Senate and denying New Jersey citizens
transparency.”
Key issues, they said, are votes on Medicare, health care, “extravagant, excessive multi-million
dollar projects that offered little or no short-term economic benefits.”
A spokesman for the state Secretary
of State’s office acknowledged receipt of the committee’s September letter, but noted the U.S. Constitution only
allows for a senator’s removal from office for three reasons — death, resignation or a two-thirds vote by the
Senate itself.
He declined to discuss more since the case is before the courts.
The state constitution allows
for the recall of the governor or “Members of Congress,” much the same as it allows recall of local officials.
However, to even get to an election, the recall committee must gather signatures equal to 25 percent of the number of voters
in the last presidential election. In 2008, 3.67 million people went to the polls in New Jersey, meaning the petitions must
get more than 917,000 signatures. When he won election in 2006, Menendez’ opponent, Thomas Kean Jr., received about
977,000 votes.
Other states that have similar language in their constitutions, such as Michigan and Oregon, have determined
members of the Senate and House of Representatives are federal officers and there is no mechanism in the U.S. Constitution
that allows for a recall and that supersedes their state constitutions.
A report prepared two years ago by the Congressional
Research Service concluded it would take a constitutional amendment to allow a recall of a member of Congress. The report
noted the U.S. Supreme Court already has ruled states have no authority to impose term limits on senators and representatives.
The
New Jersey effort isn’t the only one ongoing. An effort in Louisiana is attempting to get a recall of Sen. Mary Landrieu
started there because she “doesn’t listen to the people.”

Littell McHose, along with State Assemblyman Gary R. Chiusano and their staff have been laboriously investigating
my allegations of malfeasance
behavior within the New Jersey Office of Attorney Ethics. Although I have a large
amount of real evidence, this diligent legislative team have faced a number of roadblocks.
The largest roadblock being the fact that the Office of Attorney Ethics is a commissioned office of New Jersey’s
Supreme Court. The fact that I’m considered 100% disabled by the federal
Department of Veterans Affairs (VA), due to Post Traumatic Stress Disorder (PTSD) compounds the problem in various ways. Three months ago, Senator Steven Oroho had to meet directly with New Jersey Supreme Court Justice Barry T. Albin. His actions were done in order to move the Office of Attorney Ethics to release the simplest of information
of their former Vice-Chairman Robert Correale, who, along with his former law firm, Maynard & Truland, are at the center
of this investigation. This meeting and follow-up letter addressed to all New
Jersey Supreme Court justices took place, because the lack of response to Senator Oroho office’s formal letter from
February of this year, requesting this same information. Why it took until
June to answer simple questions was excused and an apology was given to Senator Oroho and his staff from the Office of Attorney
Ethics.
For almost nine (9) years now, I have been getting this same (And a little
worse) runaround from the New Jersey Office of Attorney Ethics, the New Jersey’s governor’s office, the state’s attorney
general’s office and both the Supreme and Superior Court systems. I tremendously
appreciate the unending efforts of New Jersey
legislators Senator Oroho, Assemblywoman Littell McHose, Assemblyman Chiusano and their gracious and dedicated staff. Their bills before the NJ legislature concerning PTSD veterans, and the recent announcement of a Supreme
Court reform for comprehensive public examination and access to court records, are
major steps forward. I’m praying
that their continued efforts in this investigation gain more support from additional New Jersey government officials.
I’m especially looking forward to the
day when all the parties at the center of this indignation are brought to justice, so they can never use their government
influence negatively against New Jersey’s citizens again.
It’s time for justice in New Jersey.
